Parkland couple fighting to have neighbor’s dog euthanized, tested for rabies

One minute, Crystal Kantor was chatting on the street with one of her Parkland neighbors. The next, she was prying the jaws of the neighbor’s pit bull off her pet beagle.

Now, Kantor has filed suit against the neighbors and Broward County to have the dog, Zina, euthanized.

Kantor wants it tested for rabies, which can only be done on the brain of a dead dog. The case is assigned to Judge John Bowman.

Broward Animal Care and Adoption Director Thomas Adair said he wasn’t aware of any other such lawsuits in the past. State health department officials couldn’t say, either.

Human rabies is rare, with only two to three cases reported each year in the United States, according to the state health department. The last case of a human acquiring rabies in Florida was recorded in 1948.

Broward animal control officials quarantined Zina, who is owned by Joan and Irwin Mandel, and say the dog posed no rabies risk when it attacked, but Crystal Kantor doesn’t trust that.

Adair said the county followed the protocols set by the state’s Department of Health. That called for a 10-day quarantine of Zina. If a dog had rabies present in its saliva, it would exhibit signs of the virus within five to seven days, Adair said. The quarantine period is even longer, for a margin of safety.

“It’s pretty well known and pretty definitive that if it lives 10 days after the bite, then everything’s OK,” Adair said.

The county has no authority to euthanize the dog. Zina doesn’t meet the criteria for a dangerous dog in Broward that could be eligible for euthanasia, the county determined. The county’s dangerous-dog laws were reformed several years ago to give dogs that attack other dogs another chance. A dog that attacks and seriously injures a human can be dealt with more severely, but that’s not what happened in this case, the county says.

Kantor and her sister suffered bites while intervening in a dog-on-dog attack, Adair said the county concluded.

“The dogs broke loose from the owners’ home and attacked the other dogs,” Adair said. “During the process of trying to separate them, there were two people bitten.”
